Why Choose a Private Drug Charge Defense Attorney Over a Public Defender?

We receive telephone calls all the time from potential clients who are seeking help with their pending criminal matters. One of the most common questions is: “Why should I hire a private lawyer and not take a public defender?” These are the reasons:

It's your right to have an attorney, but you don't get to choose your attorney if you are appointed a public defender.

The 6th amendment of the U.S. Constitution guarantees every citizen the right to counsel for any criminal proceeding. You can choose any attorney you want as your legal counsel. However, if you accept appointment of a public defender, you do not get to choose who is assigned as your lawyer. Although there are many fine young attorneys who work in public defender offices, your case could come down to the luck of the draw. You just have to pray that you get an attorney who will have the right passion and knowledge to properly handle your case.


You need an attorney who can devote time and attention to your case.

It is no secret that public defenders are usually overworked and extremely underpaid. They can be difficult to get ahold of and will typically not talk to your family members. This is important to note. Many defendants would like to have family members involved in discussions about their case. Usually a public defender doesn't have the time to get the client's consent to talk with a family member, even if they wanted to. Our attorneys make the time to answer your questions and discuss your case with you or your family, if that’s what you prefer.

There are many public defenders who have solid legal experience. Some will have less experience than others, with little or no trial experience, though. (And it is extremely rare to have a public defender who also has experience as a prosecutor.) The public defender assigned to your case might depend on the type of charges you are facing, who your co-defendant is (due to conflict), which court you are in, and maybe what letter of the alphabet your last name starts with.


In Mohave County, public defenders are assigned by courts and divisions. That often means that the public defender assigned to a case changes when the case is transferred from one division to another. This limits the public defenders’ experience on which judges they appear before, as well as the types of cases they handle. In other words, your defense will be based more on efficiency for the courts rather than which attorney is right for your specific case.
